Maryland Smoke Alarm Placement Rules

Maryland law mandates at least one smoke alarm in each residential sleeping area. More specific placement rules apply to homes constructed on or after July 1, 2013, making the construction date an important detail when reviewing existing devices or planning an installation.

In homes constructed on or after that date, detectors must be located in each sleeping room and in a hallway or common area outside the sleeping rooms. Every dwelling level must also have a detector, including the basement. This level-by-level provision excludes unoccupied attics, garages, and crawl spaces.

Placement considerations include:

• Detectors inside individual bedrooms
• Detectors in hallways or common areas outside sleeping rooms
• Coverage on each occupied level of the home
• Basement coverage when the dwelling includes a basement

These provisions may be enforced by the State Fire Marshal, a county or municipal fire marshal, a fire chief, or another authority having jurisdiction. This authority is the public official or agency responsible for applying the relevant fire and building rules to a property or project.

Maryland Replacement & Interconnection Rules

For residential units constructed on or after January 1, 1989, two or more mandated alarms must be interconnected. When one connected unit detects smoke and activates, the others in the residence activate as well.

Existing alarms in a one-family or two-family dwelling must be upgraded when they exceed 10 years from the manufacture date or fail an operability test. An upgrade is also triggered when a permit is issued for an addition or alteration. The manufacture date is generally more useful than the purchase date because a unit may have been stored before installation.

Maryland replacement rules distinguish between power sources:

• A battery-only replacement must use a sealed 10-year battery.
• A battery-only replacement must include a silence or hush feature.
• A hardwired AC-powered smoke alarm can’t be replaced with a battery-only alarm.

A sealed 10-year battery is built into the unit and isn’t intended for routine battery changes. A silence or hush feature temporarily reduces nuisance alarms without cutting power. Hardwired units receive AC power from the home’s electrical system and may also include battery backup.

When evaluating aging detectors, check each unit’s manufacture date, power source, and interconnection status. These details clarify whether the project involves a straightforward replacement or wiring associated with a hardwired system.
